Judge Rules Fani Willis Must Remove Nathan Wade or Withdraw from Trump Case
Judge Scott McAfee has proposed a compromise in the Trump case, suggesting the removal of Nathan Wade or the entire Fulton County DA’s office, led by Fani Willis, to address concerns of impropriety without disqualifying Willis.

Judge Scott McAfee has opted not to disqualify Fulton County District Attorney Fani Willis from the case against former President Donald Trump, despite concerns over her personal relationship and travels with lead prosecutor Nathan Wade. McAfee determined the defense did not demonstrate that Willis acquired an actual conflict of interest. Nevertheless, he pointed out the presence of a significant appearance of impropriety within the prosecution’s current setup. To resolve this issue, McAfee stated that either Nathan Wade must withdraw from the case, or Willis and her entire office should step aside, allowing the case to be reassigned by the Prosecuting Attorneys’ Council, as per O.C.G.A. § 15-18-5.

This directive emerged after allegations from Trump co-defendant Michael Roman that Willis had financially benefitted by awarding Nathan Wade, her purported romantic partner, a lucrative contract to serve as special prosecutor, which he allegedly used to fund vacations for the two, as reported by the Daily Caller. Both Willis and Wade have denied that their relationship began prior to his appointment, with testimony from Willis’s long-time friend Robin Yeartie contradicting their defense, suggesting the relationship started in 2019. They have asserted that their vacation expenses were shared equally, with Willis reimbursing Wade in cash.

In his ruling, McAfee expressed concern over the credibility of Willis and Wade’s testimonies regarding the onset of their relationship, noting an “odor of mendacity.” He underscored that the court is not obliged to verify the veracity of every witness’s statements but indicated that the doubts surrounding the duo’s relationship necessitate corrective measures to eliminate any appearance of impropriety.

Furthermore, McAfee addressed other disqualification arguments, including Willis’s failure to disclose gifts from Wade on her financial disclosures and her controversial church speech in January, which has been criticized for potentially influencing the case. He described the speech as “legally improper” and suggested that restricting public comments on the case might be necessary to avoid prejudicial pretrial publicity.

Witness testimonies, such as that of Yeartie and Terrance Bradley, Wade’s former law partner, were evaluated but found lacking in detail and context. Bradley’s unreliable testimony and inconsistent recall further complicated the judge’s ability to draw conclusions based on their accounts.

The ruling follows McAfee’s decision to dismiss six counts of the indictment against Trump for lacking sufficient information for the defendants to prepare a defense adequately. Steve Sadow, Trump’s lead defense counsel, stated they respect the court’s decision but plan to explore all legal avenues to contest the case’s legitimacy and address the alleged prosecutorial misconduct by Willis and Wade.
