On Monday, during an interview on Hugh Hewitt’s nationally syndicated radio show, Sen. Tom Cotton (R-AR) expressed confidence that the Supreme Court would step in to reprimand liberal judges who interfere with the commander-in-chief’s constitutional responsibilities.
His remarks followed an attempt by U.S. District Court Judge James E. Boasberg to block the Trump administration’s use of the Alien Enemies Act to deport illegal alien gang members.
Cotton criticized Judge Boasberg’s decision, referring to him as a “rogue judge” and arguing that his actions overstepped judicial authority. “The Department of Justice, under Pam Bondi’s signature, just filed a motion to vacate this hearing because there’s no legal ground for it,” Cotton stated.
“This judge tried to intervene with an overseas military flight that had already left U.S. airspace, attempting to redirect it back to the United States. This flight was carrying known murderers and rapists—dangerous gang members who were being deported to El Salvador, a country that was willing to take them.”
Cotton further argued that the Trump administration had fully complied with the judge’s initial order but noted that the subsequent written order failed to justify any legal basis for further hearings.
“If this rogue Obama judge insists on interfering with the President’s core responsibilities, I have no doubt this will go to the Supreme Court swiftly.
And I fully expect the Court to uphold President Trump’s actions while delivering a well-deserved rebuke to these liberal judges who continually attempt to obstruct the executive branch.”
Hewitt then pointed out the historical context of the Alien Enemies Act, noting that while the Sedition Act was repealed in 1920, Congress had deliberately chosen to keep this law in place. He observed that this case marked the first time the law was being tested under the specific circumstances of a non-state actor declaring an invasion.
“I cannot imagine the Supreme Court ruling against the President,” Hewitt remarked, “but do you think they even want to get involved in this case, Senator?”
Cotton responded forcefully, stating that it would be highly unlikely for the Court to intervene against the President’s constitutional authority. “It would be absurd for the Supreme Court—or more accurately, a lone trial judge—to tell the President he cannot detain and remove terrorists from the country, just as it would have been after 9/11 if a judge had tried to prevent the removal of al Qaeda operatives.
Yet, here we are, with Democrats and liberal judges seemingly defending savage criminals just to oppose Donald Trump.”
He also referenced another controversial case involving a doctor in New England who was denied reentry into the U.S. due to her attendance at the funeral of Hezbollah leader Hassan Nasrallah.
“You can’t make this up,” Cotton said. “The left is so blinded by Trump Derangement Syndrome that they are willing to side with terrorists and violent criminals just to resist the President.”
The conversation highlighted the ongoing battle between the executive branch and certain judicial rulings that attempt to curtail presidential authority over national security and immigration enforcement.
As this legal challenge unfolds, all eyes will be on the Supreme Court to determine whether it will uphold the President’s authority or entertain further judicial intervention.
