President Trump denounces clemency actions signed with autopen, calls them legally void and questions Biden’s competence and knowledge of decisions.

President Donald Trump announced that pardons issued by Joe Biden using an autopen are “VOID, VACANT, AND OF NO FURTHER FORCE OR EFFECT,” stating that Biden neither signed nor was aware of the documents. The statement, posted late Sunday on Truth Social, directly challenges the validity of numerous clemency actions, alleging Biden’s detachment from key decisions and raising concerns over potential legal violations by his aides.
“The ‘Pardons’ that Sleepy Joe Biden gave to the Unselect Committee of Political Thugs, and many others, are hereby declared VOID, VACANT, AND OF NO FURTHER FORCE OR EFFECT, because of the fact that they were done by Autopen,” Trump declared in the post. “Joe Biden did not sign them but, more importantly, he did not know anything about them!”
Trump claimed the pardoning documents were never explained to Biden and not approved by him. “He knew nothing about them, and the people that did may have committed a crime,” Trump wrote. He added that those involved in the January 6 Committee’s investigation “should fully understand that they are subject to investigation at the highest level.”
Trump also criticized Biden’s use of the autopen while visiting the Department of Justice, raising concerns about official documents signed without the President’s direct involvement. “That autopen is a big deal. I don’t know, you know? Who’s doing this?” Trump asked. “You don’t use autopen. Number one, it’s disrespectful to the office. Number two, maybe it’s not even valid.”
Trump’s remarks followed findings by The Oversight Project revealing that Biden’s autopen had been used to sign pardons while Biden was vacationing in St. Croix on December 30, 2022. These documents, marked as signed “at the City of Washington,” raised concerns over their legitimacy given Biden’s location in the U.S. Virgin Islands at the time.

Additionally, a new analysis released by The Oversight Project on January 19, 2025, indicated Biden used the autopen to pardon family members, Dr. Anthony Fauci, General Mark Milley, January 6 Committee members, and Gerald Lundergan. Of 51 clemency warrants analyzed, 16 bore signatures from “Autopen A,” 16 from “Autopen B,” and only 19 showed apparent wet-ink signatures.
The analysis further noted subtle differences between Autopen A and Autopen B, such as variations in the spacing of letters and the appearance of Biden’s name suffix, raising questions about the consistency and authenticity of these signatures.
The New York Post corroborated the report, uncovering that Biden’s top aides may have controlled the use of the autopen and approved documents without his consent. One insider reportedly described Biden’s White House as a “puppet show,” stating, “There is no clarity on who actually approved what — POTUS or [the aide].”
Amid increasing scrutiny, Missouri Attorney General Andrew Bailey demanded records to assess Biden’s decision-making capacity during his presidency. Meanwhile, former First Lady Jill Biden admitted to concealing Biden’s mental decline from the public. White House Press Secretary Karine Jean-Pierre, despite Biden’s public struggles, claimed Biden was “as sharp as ever.”
President Trump concluded his statement by asserting that Biden’s failure to engage with critical decisions has caused significant damage. “If he did, all of these bad things wouldn’t be happening,” Trump said.
